Abstract
El trabajo fin de grado titulado: “la inconstitucionalidad de las tasas judiciales” tiene la finalidad de analizar los problemas generados por la implantación de dicha Ley.
La aprobación de la Ley 10/2012, de 20 de noviembre, por la que se regulan determinadas tasas en el ámbito de la Administración de Justicia y del Instituto Nacional de Toxicología y Ciencias Forenses, provocó la reacción negativa de los operadores jurídicos. Tanto los Jueces como los abogados, consideran esta norma inconstitucional por limitar el derecho a la tutela judicial efectiva en condiciones de igualdad. Igualmente, ha sido criticada por no respetar el principio de capacidad económica de los justiciables.
Además de los problemas constitucionales derivados de su aplicación, también surgen dudas acerca de su adecuación a la Ley General Tributaria y la Ley de Tasas y Precios Públicos.
Algunas cuestiones controvertidas han sido solucionadas por el Tribunal Constitucional en la sentencia núm. 140/2016, de 21 de julio 2016.
Las tasas judiciales no son novedad legislativa, ya en la época preconstitucional se implantaron para sostener el servicio público de la Administración de la Justicia. Debido a la aprobación de la Constitución Española se eliminó dicho tributo del Ordenamiento jurídico, con el objetivo de respetar el contenido de la norma suprema.
Todo ello nos llevará a estudiar los antecedentes legislativos de esta figura tributaria, el por qué de la reintroducción de las tasas en el sistema tributario y los conflictos jurídico-financieros suscitados.
Finalmente, se expondrán las conclusiones que se desprendan del impacto de la Ley de Tasas Judiciales en el Ordenamiento jurídico. The paper entitled: “judicial taxes unconstitucionality” aims to analyse the problems generated by the implementation of this law.
The approval of the law 10/2012 of 20 November, which regulates certain rates in the field of the administration of Justice and the National Institute of forensic science and toxicology, provoked negative reaction of legal operators. The judges and lawyers considered this rule unconstitutional for limiting the right to effective judicial protection under conditions of equality. Also, it has been criticized for not respecting the principle of economic capacity of individuals.
In addition to the constitutional problems arising from its application, also doubts about his adaptation for the General tax law and the law on fees and public prices.
The courts fees are not legislative innovation, already in the pre-constitutional era were implanted to defray the public service of the administration of Justice.
Due to the approval of the Spanish Constitution removed the tribute of the legal system, with the aim of complying with de Magna Carta.
All this will lead us to study the legislative history of this tax figure, the reason for the reintroduction of the rates in the tax system and other legal problems.
Finally, in the conclusions we will propose some solutions for the problems originated by the mentioned Law.
