Los delitos contra la seguridad vial: aspectos administrativos y penales

Abstract

La elección de la temática del presente trabajo es, ciertamente, importante pues la seguridad vial es una cuestión social de primer orden. Basta con citar que en España, durante los años 2006-2015 se produjeron 25.239 víctimas mortales y 1.279.553 lesionados. Por ello, el presente trabajo intenta concienciar al lector de la importancia de este tema, que desafortunadamente, no deja de estar de actualidad por este motivo. Para ello, tomando como punto de partida una breve introducción de los principales factores que influyen en la seguridad vial, como son el vehículo a motor o ciclomotor, la conducción o el bien jurídico protegido, abordaremos, asimismo, el ilícito administrativo, para continuar con el eje fundamental del trabajo, el análisis exhaustivo de las infracciones en materia de seguridad vial tipificadas en nuestro Código Penal, así como las medidas sustitutivas y la retirada del carnet de conducir. Finalmente, una vez examinado el desarrollo normativo en este sentido, pasaremos a examinar las sentencias más mediáticas a este respecto.

The election made regarding the subject of this report is, certainly, important since the road safety is an important social matter. It should be enough saying that in Spain, between 2006-2015 there were 25.239 dead people and 1.279.553 injured people. Consequently, this essay is intended to raise the awareness of the readers about the importance of the subject, that unfortunately, it still topical. We will consider as starting point, the factors which are influencing in the road safety such as motor vehicle or motorcycle, the conduction and the institution legally protected. We will tackle as well, the unlawful behaviors of the administration, to continue with an exhaustive analysis of the infringements in road safety which are foreseen in the criminal code as well as the substitute measures, and driving license removal. In the end, once reviewed the legislation regarding these topics, we will review the court decisions, highlighting those decisions in which the media have been focused.
