El derecho al olvido. Estudio de la sentencia del CJUE Google Spain y consecuencias en el ordenamiento comunitario

Abstract

El objetivo de este trabajo consiste en realizar una presentación detallada sobre una de las cuestiones jurídicas que más relevancia ha tenido en el panorama mundial en los últimos años, el derecho al olvido. Para ello haremos un estudio de su concepto y su naturaleza jurídica, así como de sus orígenes y sus características más importantes. En la segunda parte del trabajo nos centraremos en la sentencia que dio origen a este nuevo derecho el llamado caso Google Spain. Y por último analizaremos las consecuencias de esta sentencia y el nuevo reglamento de protección de datos que se creó recientemente en Europa.

The object of this project is make a detailed presentation about one of the most relevant legal issues on the world scene in recent years, “the right to be forgotten”. To that effect, we make a study of it concept and its legal nature as well as of its origins and its most important characteristics. In the second part of the document, we will focus on the judgmen that gave rise to this new right called the case Google Spain. Finally, we will analyze the consequences of this sentence and the new regulations of data protection that was created recently in Europe.
