Abstract

Hay cosas que hacen los jueces que están impactando la esfera política, la esfera de quienes representan a los otros órganos estatales. Durante mucho tiempo se aceptó que los jueces tenían un ámbito de acción distinto al de las otras instituciones públicas; sin embargo en los últimos años esto se ha ido modificando. Se asiste a un progresivo desmantelamiento de aquella idea, hoy la visión del juez “boca de la ley”, aplicador mecánico de normas, se aleja de las funciones que está desempeñando. Este alejamiento ha contribuido a que se hayan ido instalando conceptos como judicialización de la política o activismo judicial.
