Las Defensorías: el desafío de construir puentes de acceso a la justicia

Abstract

La noción de justicia es una de las más universales y está incluida en todos los marcos normativos conocidos. Nuestro objetivo es lograr que todos puedan acceder al derecho y a la justicia. El derecho a la Justicia es uno de los Derechos Humanos: integra nuestro ordenamiento jurídico con rango constitucional. En una sociedad de incluidos y excluidos las instituciones de garantías son necesarias, puesto que no existe un total acceso a la justicia. 1) Acceso al conocimiento y al asesoramiento: creación del portal www.ciudadyderechos.org.ar; el mismo abarca y ordena temáticamente la enmarañada normativa. Por su parte, la Oficina de Atención y Asesoramiento certificó ias Normas ISO 9001-2000 en diciembre de 2007. 2) ¿Por qué seguir un camino único cuando podemos construir alternativas? Promoción de la mediación y el arbitraje como medios alternativos de resolución de conflictos y por tanto de acceso a la justicia. 3) Probation: abriendo la institución y brindando un ámbito de trabajo. 4) Defensoría como institución de garantía y de referencia: La Defensoría se ha constituido como Observadora en algunos procesos penales. Conclusión: Somos conscientes de que hay mas justicia para alcanzar, al menos en nuestro país y continente: es la justicia social y la equitativa distribución de las riquezas. La acción por la justicia es una forma de garantizar la paz y democracia. Por ello la Defensoría del Pueblo de la Ciudad de Buenos Aires creó puentes para que todos puedan tener justicia.

The knowledge of justice has been present since the beginning of society. Our work is orientated to achieve a main objective: access to the justice for everyone. We believe that the access to the justice is a Human Right. This statement is present in our constitution. In a socíety of included and excluded people, the institutions of guarantees are necessary, because there is not a full access to the justice for everyone. 1) Access to the Knowledge and to the Advice. The Office of Attention and Advice certified the Procedure ISO 9001-2000 in December, 2007. 2) Why we should follow one way, whcn we could build alternatives? Conclusión: we are aware that there is more justice to achieve in our country and continent: the social justice and the equitable distribution of wealth. Justice is one way to guarantee peace and democracy. That is the reason because we continuous building ways of access to the justice.
