This contribution delves into one of the most striking phenomena observed in the Basque Country in the last few years: the treatment given to immigration by the Basque
Administration. Basing on a close stud y of news and editorials recently appeared in the local press, we come to the conclusion that most of the initiatives put forth by the Autonomous Government regarding this subject are the result of a direct reaction to opposite attitudes shown and legislation passed by the Spanish Government. In spite of the
progressive and ground-breaking measures taken by Basque officials, one has the impression that they do not respond to an analysis of the real needs of the migrant
contingen t but rather to an intention to mark "the difference" with respect to the central Government's policy.

The present study aims to survey the evolution of the European immigration policy. This article analyzes the development of the immigration common policy from 1975 to the present. The European proposals and measures adopted to face the challenges of the immigration phenomena are tackled too. A compilation of the European rules referring the inflow of nationals coming from third non-communitarian countries is one of the subjects
that are deeply referred in the article. Finally, some thoughts on the perspectives of the immigration common policy are presented and organized in four policy's guidelines.

This article reviews the construction of migration policies in Spain while analyzing its role as an instrument in the production of exclusion and precariousness. The changes in migration legislation-far from decreasing the number of undocumented
migrants-have produced labor segmentation and social stratification. The official determination of presenting illegal immigrants as part of a vicious circIe and legal ones as
part of a virtuous circIe opens the door to the criminalization of migration movements. This situation produces a radicalization in the vulnerability of certain labor forces. As opposed to
the culturalist perspective, which explains inequality as the result of pre-existent cultural differences, the following analysis suggests that the discriminatory and marginalized situations suffered by part of non-communitarian immigrant population in Spain are systematically produced and reinforced by various political and legal practices.
